The care trust established in anticipation of one’s future loss of autonomy is a particularly suitable instrument for governing the complexity of caring for a non-autonomous person, as it allows for a flexible and personalized planning of care arrangements. Its function does not merely consist in asset segregation, but rather lies in the possibility of structuring a complex causal programme in which the assets are purposefully allocated to the protection of the person. At the same time, the trust proves to be especially appropriate for pursuing the aim of remunerating and/or compensating the work of the family caregiver, taking into account the quality of the relationship between caregiver and beneficiary - which is reflected in the causal qualification of the transfers - as well as the quality and extent of the care provided. From a succession law perspective, the trust does not circumvent forced heirship rules; instead, it enables a more refined articulation of dispositions, reconciling the recognition of caregiving work with the protection of forced heirs, thereby fostering the legal recognition of care.
