La rivincita di Ascarelli e del giudice a quo Pizzorusso [The rematch of Ascarelli and Judge a quo Pizzorusso]

The relationship between the criterion of interpretation in conformity with the Constitution and the criterion of “living law” has always been (potentially) conflicting, representing two different answers to the same problem: common judges and the Constitutional Court, which norm should they privilege in the exercise of their institutional functions? The text traces the relevant constitutional jurisprudence, pointing out how today we are witnessing the downsizing of the former hermeneutical criterion and the appropriate recovery of the latter.

Il rapporto tra il criterio dell’interpretazione conforme a Costituzione e il criterio del “diritto vivente” è sempre stato (potenzialmente) conflittuale, rappresentando due differenti risposte al medesimo problema: giudici comuni e Corte costituzionale, quale norma devono privilegiare nell’esercizio delle loro funzioni istituzionali? Il testo ripercorre la giurisprudenza costituzionale pertinente, segnalando come oggi si assista al ridimensionamento del primo criterio ermeneutico e all’opportuno recupero del secondo.
