Ammortizzatori sociali tra utopia costituzionale e distopia applicativa [ Social Security Benefits for the unemployed between constitutional utopia and practical dystopia]

The essay takes its starting point from the constitutional principles enshrined in Articles 38 and 3, paragraph 2, of the Italian Constitution, thereby outlining the contours of the unemployment protection system. Its aim is to assess whether the reforms introduced to social security benefits for the unemployed in the 2023–2025 biennium — with reference to the Short Time Earning Fund (Cassa Integrazione Guadagni), NASpI, and ISCRO — succeed in overcoming the structural shortcomings of the system and bring it closer to constitutional requirements.

Il saggio trae abbrivio dai principi costituzionali degli artt. 38 e 3, co. 2, definendo così i contorni del sistema di tutela per la disoccupazione. L’obiettivo è quello di analizzare se le modifiche apportate agli ammortizzatori sociali nel biennio 2023-2025, con particolare riferimento alla Cassa integrazione guadagni, alla NASpI e all’ISCRO, superino o meno le aporie strutturali del sistema, per avvicinarlo ai dettami costituzionali.
