Presumably in the wake of judgment no. 105/2023 rendered by the Italian Constitutional Court, the Supreme Court has recently come to award detainees held under the “41-bis” special prison regime the possibility to give small toys or sweets to their children or direct grandchildren under the age of twelve. This ruling rests on a Constitution-based interpretation of Article 41-bis, paragraph 2-quater, letter b) of the Prison Administration Act, where it establishes that visits must take place “in rooms equipped in such a way as to prevent the delivery of objects”. This decision reaches an acceptable result, even though it relies on an interpretive technique which is far from undisputable in the case at hand. Therefore, the potential influence that this ruling may have on future decisions by both the Penitentiary Authorities and the Courts is uncertain.

Verosimilmente sulla scorta della sentenza della Consulta n. 105/2023, la Suprema Corte è recentemente giunta a riconoscere al detenuto in regime speciale la facoltà di essere ammesso a consegnare piccoli giocattoli oppure dolciumi ai figli o ai nipoti (in linea retta) minori di dodici anni, attraverso una esegesi secondo Costituzione dell’art. 41-bis, comma 2-quater, lett. b), ord. penit., là dove stabilisce che i colloqui devono svolgersi “in locali attrezzati in modo da impedire il passaggio di oggetti”. Si tratta di una pronuncia che perviene ad un risultato condivisibile, avvalendosi tuttavia di una tecnica interpretativa nel caso di specie tutt’altro che pacifica, e dunque dall’incerta capacità di influenzare le future decisioni al riguardo tanto dell’autorità penitenziaria quanto degli organi giurisdizionali.
