The paper retraces, in summary, the process of progressive empowerment of the worker in the workplace safety system, highlighting the path of increasing his involvement among the subjects holding their own autonomous shares of responsibility. Starting from this assumption, the question is then raised as to the relevance of the worker’s contributory negligence in producing the harmful event they are a victim of. In this perspective, we underline, in particular, the persistent jurisprudential rigor in generally denying the validity of such a defence, even in hypotheses in which, on the contrary, a correct reconstruction of the typical nature of criminal negligence could lead to different outcomes..
