L'elezione di Ilaria Salis e la richiesta di revoca dell'immunità parlamentare europea [Ilaria Salis’ election and the waiver of European parliamentary immunity]

The purpose of this article is to examine the request for waiver of the European parliamentary immunity of Ilaria Salis. The analysis focuses, on the one hand, on the starting date of the prerogative in question and, on the other, on the practice and case-law relating to the assessment of the conditions for its waiver, highlighting the consequences that a possible refusal would have on the autonomy of the Parliament in relation to the Member States of the Union.

Il contributo si pone l’obiettivo di indagare la richiesta di revoca dell’immunità parlamentare europea di Ilaria Salis. L’analisi si concentra da un lato sulla decorrenza della prerogativa in esame e, dall’altro, sulla prassi e sulla giurisprudenza in materia di valutazione dei presupposti per la sua revoca, evidenziando gli effetti che un eventuale diniego produrrebbe sull’autonomia del Parlamento rispetto agli Stati membri dell’Unione.
