Giurisdizione civile e nuove tecnologie. II. Intelligenza artificiale, giustizia predittiva e prevedibilità della decisione giudiziaria

This article engages in a scholarly reflection upon the so-called predictive justice, yet does so utilizing the analytical instruments of procedural law rather than the methodologies of legal informatics, which typically confront the substantial issues raised by the emergence of artificial intelligence within the critical sphere of judicial functionality. Commencing with the universally fundamental concept of legal certainty – a concept intrinsic to every legal system throughout history and across jurisdictions – and the complementary aspect of the predictability of judicial decisions, the treatise provides a nuanced examination of the logical framework of civil rulings in relation to the predictive and adjudicative faculties of artificial intelligence. Despite this, the investigation maintains a cautious stance regarding the tangible prospects of artificial intelligence in the administration of civil justice. Nevertheless, the discourse recognizes the current and potential future contributions of computational tools in augmenting the adjudicative processes.

L’articolo offre una riflessione sulla cd. giustizia predittiva, condotta però con gli strumenti di analisi comunemente adoperati dal processualista, piuttosto che con quelli di cui si serve l’informatica giuridica per affrontare i rilevanti problemi posti dall’avvento dell’intelligenza artificiale anche nel campo nevralgico della funzione giurisdizionale. Muovendo dal tema fondamentale per qualsiasi ordinamento giuridico, in ogni tempo e in ogni luogo, della certezza del diritto, complementare a quello della prevedibilità delle decisioni giudiziarie, si svolgono alcuni approfondimenti sulla struttura logica della sentenza civile in rapporto alle capacità predittive e decisionali dell’intelligenza artificiale, con esiti tuttavia ancora scettici sulle sue effettive potenzialità nel settore della giustizia civile; vengono comunque valorizzate nel testo le ottime applicazioni di supporto che già oggi l’informatica fornisce all’attività del giudice, e che sempre più saprà offrire in futuro.
