La Corte costituzionale e la scienza: alcune tendenze e punti fermi [The Constitutional Court and science: some trends and milestones]

What novelties are emerging in the Court’s attitude to judging science-based laws? Are there similarities with other trends taking place even in different areas of the legal system? The essay identifies some obvious constants in the constitutional jurisprudence on the subject, while pointing out the contrasts with the different options put forward in the resolution of some discussed and “sensitive” cases. In particular, there emerges an attitude of the Court somewhat in favor of solutions calibrated to the cases and persons involved, as opposed to solutions of quite a different nature (which, however, continue to emerge mainly in legislation and, albeit sporadically, also in constitutional jurisprudence)

Quali novità emergono nell’atteggiamento che la Corte adotta per giudicare le leggi scientificamente fondate? Ci sono somiglianze con altre tendenze in atto anche in ambiti diversi dell’ordinamento? Il saggio individua alcune evidenti costanti della giurisprudenza costituzionale in materia, sottolineando tuttavia i contrasti con le diverse opzioni messe in campo nella soluzione di alcuni casi discussi e “sensibili”. In particolare, affiora un atteggiamento della Corte alquanto favorevole a soluzioni calibrate sui casi e sulle persone coinvolte, di contro a soluzioni di ben altra natura (che comunque continuano a emergere soprattutto nella legislazione e, sia pur sporadicamente, anche nella giurisprudenza costituzionale).
