Il diritto di agire in giudizio nell'Italia competitiva [The Right to take Legal Action in competitive Italy]

The multiplication, even in a supranational dimension, of economic analyzes of judicial systems and the comparison of their performances in relation to the performance of the international economy, has contributed to the civil justice sector being considered mainly as a constitutive element of a competitive economy. One of the main consequences is that many of the recent civil justice reforms in Italy, in an attempt to reduce the duration of civil trials, have achieved the result of drastically decreasing the number of civil actions brought, especially discouraging subjects who do not have sufficient capacity to face the economic risks associated with the jurisdictional exercise of their rights. Other consequences resulting from this approach are then illustrated.

Il moltiplicarsi, anche in una dimensione sovranazionale, delle analisi eco- nomiche dei sistemi giudiziari e la comparazione delle loro performances in relazione all’andamento dell’economia internazionale, ha contribuito a far considerare il settore della giustizia civile principalmente come un elemento costitutivo di un’economia competitiva. Una delle principali conseguenze è che molte delle recenti riforme della giustizia civile in Italia, nel tentativo di ridurre la durata dei processi civili, hanno realizzato il risultato di diminuire drasticamente il numero di azioni civili intentate, disincentivando soprattutto i soggetti che non hanno una capacità sufficiente ad affrontare i rischi economici connessi all’esercizio giurisdizionale dei propri diritti. Vengono poi illustrate altre conseguenze derivanti da tale approccio.
