With the conversion of l.d 6 November 2021, no. 1521, an amendment was approved which introduced interesting changes to the codified laws and regulations of the shipping contract, particularly in art.t 1737 (providing for the possibility of conferring power of representation on the shipper), 1739 (relating to the obligations of the shipper) and 1741 (relating to the carrier shipper), as well as art. 1696 (for compensation for damages for loss or damage to the things transported) and 2761 (special privilege of the shipper) thus responding to the need felt for some time by companies in the sector, that is to operate in a regulatory framework updated to the reality of the current market. Through this reform, the legislator has also implemented the evolution consolidated at the jurisprudential level especially in terms of rights, obligations and consequent responsibilities of thecontracting parties, in order to overcome the uncertainties in application and consequently avoid, or at least significantly reduce, litigation.
Con la conversione del d.l. 6 novembre 2021, n. 1521, è stato approvato un emendamento che ha introdotto interessanti modifiche alla disciplina codicistica del contratto di spedizione, in particolare agli artt. 1737 (prevedendo la possibilità di conferire il potere di rappresentanza allo spedizioniere) , 1739 (relativamente agli obblighi dello spedizioniere) e 1741 (relativo allo spedizioniere vettore), oltre agli art, 1696 (per il risarcimento dei danni per perdita o avaria delle cose trasportate….) e 2761 (privilegio speciale dello spedizioniere) rispondendo così all’esigenza, da tempo avvertita dalle imprese del settore, di operare in un contesto normativo aggiornato alla realtà dell’attuale mercato. Attraverso tale riforma il legislatore ha inoltre recepito l’evoluzione consolidatasi a livello giurisprudenziale soprattutto sul piano dei diritti, obblighi e conseguenti responsabilità dei contraenti, al fine di superare le incertezze applicative e conseguentemente evitare, o quanto meno ridurre significativamente, il contenzioso.
