Riflessioni sulla potestas cautelare degli arbitri

The essay analyzes the regulatory framework introduced by Delegated Law no. 206/2021, implemented through Legislative Decree no. 149 of October 10, 2022, regarding precautionary protection in arbitration. The analysis focuses on the vesting of the corresponding authority, the appeal against the decision to deny or authorize the precautionary measure, and, finally, the methods of implementation of such measure. The article highlights both merits and major criticalities of the new regulatory framework, proposing interpretative solutions.

Il contributo analizza la disciplina introdotta con la Legge delega n. 206/2021 attuata con il decreto legislativo del 10 ottobre 2022, n. 149, relativa tutela cautelare arbitrale con riguardo al profilo del conferimento del relativo potere, del reclamo avverso il provvedimento che nega o autorizza la misura e, infine, delle modalità di attuazione. L’a. pone in risalto i pregi e i profili di maggior criticità della nuova disciplina normativa proponendo soluzioni interpretative.
