Dalla tutela della vulnerabilità al riconoscimento di un diritto per le donne migranti: la Convenzione del Consiglio d'Europa sulla prevenzione e la lotta contro la violenza nei confronti delle donne e la violenza domestica nella giurisprudenza nazionale

The Bologna Immigration Court’s decision adopts a gender perspective on migration, underscoring that violence against women constitutes a violation of human rights. The Court issued a decision on gender-based violence – one of the first of its kind – tackling the legal issues raised by the amendment of art. 19 d.lgs. 286/1998 by d.l. 130/2020. Among the debated aspects is the respect of the constitutional and international obliga tion of the State as non-refoulement obligation. Because of this obligation, the Court needs to apply the Council of Europe Convention on combating violence against wom en and domestic violence, human rights' instrument to protect, still not deeply explored by the national jurisprudence.
