The Digitalization of Contract Law facing the Sustainability Challenge: The Italian Experience towards the Development of EU Law

In the implementation of Directive EU 2019/770 on the supply of Digital Content and Digital Services (hereinafter: DCD) and Directive EU 2019/771 on the Sale of Goods (hereinafter: SGD) the Italian legislator did choose to deal with consumer law outside the Civil Code. DCD and SGD were implemented, by, respectively, Legislative Decree (hereinafter: LD) no 1731 and LD no 1702 of 4 November 2021. The new articles resulting from the transposition are: art 128 to 135-septies («Capo I – Della vendita di beni») Consumer Code, implementing the SGD;3 art 135-octies to 135-vicies ter («Capo I-bis – Dei Contratti di fornitura di contenuto digitale e di servizi digitali») Consumer Code, implementing the DCD. While the new provisions reproduce to a large extent the wording of DCD and SGD, they also contain some innovative solutions, which solve existing issues and, in particular, which ensure a better coordination with the Civil Code.
