Il curatore speciale del minore nella legge delega di riforma del processo civile [The minor's special legal guardian in the delegate law on civil trial reform]

This essay examines the figure of the minor’s special legal guardian as introduced by article 1, Paragraph 30, of Law No. 206/2021. The appointment of the special legal guardian must be ordered by the judge, also ex officio and under penalty of nullity of the documents in the case, in all those proceedings in which the loss of parental responsibility is envisaged, in case of adoption of those measures set out in article 403 of the Italian Civil Code or of custody of the child pursuant to article 2 and subseq. of Law No. 184/1983, or in cases where, in the course of court proceedings, a situation of prejudice to the minor emerges which may preclude an adequate legal representation on behalf of the parents, as well as when a minor who has reached the age of fourteen makes such a request. This essay analyzes the procedure of both the appointment and the revocation or modification of the special legal guardian, focusing on the requirements as well as on the locus standi and powers of procedural and substantive representation. Lastly, of paramount importance is the right of the minor to be heard by the special legal guardian.

Il saggio prende in esame la figura del curatore speciale del minore così come introdotta dall’art. 1, comma 30, l. delega n. 206/2021. La nomina del curatore speciale deve essere disposta dal giudice, anche d’ufficio e a pena di nullità degli atti di causa, in tutti i procedimenti in cui è prevista la decadenza della responsabilità genitoriale, in caso di adozione dei provvedimenti ai sensi dell’art. 403 c.c. o di affidamento del minore ex art. 2 ss. l. n. 184/1983, nelle ipotesi in cui emerga nel procedimento una situazione di pregiudizio per il minore tale da precluderne l’adeguata rappresentanza processuale da parte dei genitori, nonché quando ne faccia richiesta il minore che abbia compiuto quattordici anni. Il saggio analizza il procedimento di nomina nonché la revoca e modifica della stessa focalizzando l’attenzione sui presupposti applicativi e sulla legittimazione attiva e i poteri di rappresentanza processuale e sostanziale del curatore. Di sicuro rilievo, infine, il profilo dell’ascolto del minore da parte del curatore speciale.
