The essay deals with the issue of renewal procedures for small-scale diversion hydroelectric concessions, in the light of the Italian Antitrust Authority's position, which has indicated to the concessionary public authorities the need to disregard the regulations in force, in order to launch tendering procedures. The Italian Antitrust Authority's position is discussed and criticised from two points of view: the first relates to the notion of "direct effect" of EU legislation; the second relates to the use of analogy and its related limits in national law.
