Corpi e questioni di genere: le violenze (quasi) invisibili

The essay examines the tendency to consider completely natural and taken for granted rather invasive actions on the body of individuals motivated by the misperception of certain delicate issues related to gender and sexual identity. Specifically, the events involving transexuals and the phenomenon of surgery on intersex babies are analyzed. In some cases it has been or is still true violence (not at all perceived as such) that can literally devastate the lives of those who are subjected. Applying theoretical and juridical coordinates of a constitutional nature that the author has already developed elsewhere, the evident aporias of such a way of acting are highlighted, underlining, at the same time, which other behavioural (and juridical) approach would be decidedly more in keeping with constitutional principles.

L’articolo prende in esame la tendenza a ritenere del tutto naturali e scontate azioni alquanto invasive sul corpo dei singoli motivate dall’errata percezione di talune, delicatissime questioni attinenti al genere e all’identità sessuale. Vere e proprie violenze (nient’affatto percepite come tali) che possono letteralmente devastare la vita di chi vi viene sottoposto. Applicando coordinate teoriche e giuridicheche l’autore ha già sviluppato altrove, si mettono in luce le evidenti aporie di un simile modo d’agire,sottolineando, contemporaneamente, quale altro approccio comportamentale (e giuridico) sarebbe invece decisamente più consono ai principi costituzionali.
