The Essay deals with the rights and remedies to which is entitled the buyer of contemporary art works who -after the conclusion of the sales contract and the delivery of the good sold - finds that the work he has bought is not authentic or does not possess qualities or features espressly agreed in the contract. To this extent, the A. analyses the content of the relevant rules laid down by the italian civil code and how such rules have been interpreted and applied by the courts in cases in which contemporary art works have been sold, which proved to be non authentic or anyway not conforming to the sales contract; Great attention is paid to the questions which has not yet found a clear and inequivocal solution in the judgements of the italian Supreme Court of Cassation, especially because of the uncertainties that still characterize the rules governing the contractual liability of the seller for the delivery of aliud pro alio datum. The A. subsequently analyses the cases and circumstances in which the contracts of sale of contemporary art works are subject to the provisions of the italian consumer code, and especially discusses to which extent such provisions may find application when c-to-c contracts for the sale of contemporary art works are concluded with the intervention of a professional intermediary, such as an art gallery or an auction house. The final chapters deal with the impact of some public-law provisions of the italian “code of cultural heritage and landscape” (codice dei beni culturali e del paesaggio) on the private law regime of the sales contracts of contemporary art works.

Il saggio analizza i diritti e i rimedi spettanti al compratore di opere d’arte contemporanea, che posteriormente alla stipulazione del contratto di vendita scopra che l’opera acquistata non è autentica ovvero è priva di qualità o caratteristiche espressamente pattuite nel contratto. A tal fine l’a. procede ad una analisi delle regole generali dettata dal codice civile e del modo in cui sono state interpretate dalla giurisprudenza in una serie di casi riguardanti proprio la vendita di opere d’arte non autentiche, e soffermandosi sulle questioni problematiche che ancora non sembrano aver trovato una soluzione chiara, soprattutto in correlazione alle incertezze che tuttora connotano il regime normativo della responsabilità del venditore per consegna di aliud pro alio. Viene poi approfondito se e in presenza di quali presupposti trovi applicazione alle vendite di opere d’arte il codice del consumo, eventualmente anche alle vendite c-to-c intermediate da professionisti o case d’aste, e analizzato l’impatto dell’applicazione del codice del consumo sui diritti dell’acquirente. Infine, vengono analizzati i profili di possibile rilevanza, per la disciplina privatistica dei contratti di compravendita, di alcune disposizioni del codice dei beni culturali e del paesaggio.
