The paper analyses the way of understanding the constitutional principles related to the criminal process as it emerges from the referrals to the Constitutional Court and from its pronouncements, highlighting how the need for the social defence has triumphed for a long time both under the old and under the new criminal procedure code in spite of the individual-guarantee approach of the Italian Constitution. The Author also notes that the technique of balancing, typical of the European Court of Human Rights, also ends up favouring the punitive interest. Finally the European Court of Justice’s jurisprudence appears alarmingly in favour of the community of victims, with serious danger to the liberal vision of the criminal process.
Il contributo analizza il modo d’intendere i principi costituzionali relativi al processo penale quale emerge dalle ordinanze di rimessione alla Corte costituzionale e dai pronunciamenti della medesima, mettendo in luce come l’interesse alla difesa sociale abbia trionfato a lungo sia sotto il vecchio che sotto il nuovo codice di rito penale a dispetto dell’impronta individual-garantista della Costituzione repubblicana. L’Autore osserva inoltre che la tecnica dei bilanciamenti, tipica della Corte europea dei diritti dell’uomo, finisce anch’essa col privilegiare l’interesse punitivo. Sbilanciata in maniera preoccupante a favore della comunità delle vittime, con grave pericolo per la visione liberale del processo penale, appare infine la giurisprudenza della Corte di Giustizia dell’Unione Europea.
