Novità in tema di risarcimento del danno ambientale nelle eserienze tedesca e statunitense

In the German and North-American experiences, to obtain compensation from environmental public damage one recurs respectively to the institute for the management of someone else's affairs and to the public trust doctrine. An analysis of the relating law practices leads to some assumptions which are relevant for the Italian experience and which relate to the political-legislative capability of the overcoming of the owner logic as to the effectiveness of the compensating right in environmental matter. It is, therefore, maintained that the above overcoming does not produce any valuable result if it is separated from a legal recognition of the good subject to protection.
