The chapter intends to focus on the new forms of civic participation recently developed in the government of Italian cities. Having specified the state and regional regulatory framework, the aim will be to highlight how much the so-called “law of the city” (an expression – at least in Italy – of an innovative juridical capacity of local autonomies, projected, also by virtue of Article 118, paragraph 4 of the Constitution, towards forms of active citizenship for the care of general interests) is also contributing to a strengthening of new solutions of participatory and deliberative democracy. An example is represented by the so-called citizens’ assemblies, which, developed in other countries (not only in Europe), have also recently appeared in the statutes and regulations of some Italian cities (e.g. Milan, Bologna). Some considerations will then be developed both in terms of the need to strengthen participation mechanisms in public decision-making especially in the light of the spatial justice paradigm; and, more generally, as a viable solution, among others, for overcoming a negative model of the city, that can be summarized with the expression “hostile city”.
Partendo dai concetti cardine della città ostile, del diritto alla città e della giustizia spaziale, nel contributo sono sviluppate alcune riflessioni in ordine agli strumenti di democrazia partecipativa che possono essere impiegati dalle istituzioni pubbliche per assicurare effettività alle proprie decisioni. In un contesto di complessità sociale crescente, causato, in una fase di policrisi quale quella attuale, anche dai mutamenti climatici, in chiusura vengono analizzate le norme adottate dal Comune di Milano e dal Comune di Bologna per regolare un nuovo strumento di partecipazione - l'assemblea per il clima - che assicuri il coinvolgimento della popolazione locale nell'adozione di decisioni a forte impatto sulla sfera dei cittadini e, più in generale, sulla vita nelle città.
